A lithium ion cell or pack is classified in 8507.60 by what it is, not as a telephone part, because batteries are named by their own heading. This is the single most frequent error in phone spares consignments and the codes are not interchangeable.

851830: Headsets and earphones
An earphone supplied in a handset box is still a headphone of 8518.30 when shipped separately as a spare, because it is an article named elsewhere rather than a part peculiar to a telephone.

Classification & cost note

Parts of heading 8517 apparatus are a large and growing trade on the back of the repair market, and the classification discipline is the same one that governs parts everywhere in Section XVI: an article named by its own heading goes to that heading, and only what is not otherwise named comes to rest as a part. That is why batteries, headphones and power adapters keep leaving this code even though they arrive in the same carton as things that stay. Repair businesses are exposed here in a way that manufacturers are not, because a mixed spares shipment can require half a dozen codes while the supplier's invoice describes everything as phone parts. The second issue is valuation rather than classification: parts bought at a discount for warranty use still have to be valued for customs on a defensible basis, and a nominal or free of charge invoice is not one.

For the purposes of heading 8517, the term "smartphones” means telephones for cellular networks, equipped with a mobile operating system designed to perform the functions of an automatic data processing machine such as downloading and running multiple applications simultaneously, including third-party applications, and whether or not integrating other features such as digital cameras and navigational aid systems.
